466. Residential accommodation It was proposed in the Budget Speech that the valuation of a rental fringe benefit in terms of the residential accommodation formula should only apply where the accommodation provided to the employee is owned by the employer or by a connected person in relation to the employer. This proposal has not been implemented. Accordingly, where an employee is provided with residential accommodation by his employer (regardless of whether it is rented or owned by the employer), such employee will, provided that he does not have an interest in the accommodation, still be taxed on the rental value determined in accordance with the formula. Employee's interest in the accommodation The provisions pertaining to an employee's "interest in the accommodation" have been broadened with effect from 1 March 1997. An employee will now be deemed to have an interest in the accommodation if: such accommodation is owned by the employee or by a connected person in relation to the employee; any increase in the value of the accommodation in any manner whatsoever, whether directly or indirectly, accrues for the benefit of the employee, or a connected person in relation to the employee; or such employee or a connected person in relation to an employee has a right to acquire the accommodation from his employer.

I do not like Clive one bit - but I still say he looks crook and I know what it feels like to have to have those sick bags on hand as I went through having to do the same for almost 12 months Clive Palmer and Clive Mensink sued by liquidators over Queensland Nickel... 5 July 2017. Clive Palmer, his nephew Clive Mensink and 19 others are being sued for about half-a-billion dollars by liquidators appointed by the Federal Government. PPB Advisory lodged a claim with the Supreme Court of Queensland to regain money for Queensland Nickel (QNI) creditors, employee entitlements and compensation. The receivers allege Mr Palmer and Mr Mensink breached their duties as QNI directors, and traded while insolvent. PPB Advisory is seeking a declaration from the court that Mr Palmer was a shadow director of QNI, and should pay more than $207 million in damages. North Queensland senator Ian MacDonald said it was the first time the Government had taken such action. "The Commonwealth as a creditor is entitled to try and recover that $74 million of taxpayers money from Mr Palmer if it can be proved that he breached the Corporations Act, " Senator MacDonald said.
